AGREEMENT AND WARNING:
I understand and acknowledge that, except for limited circumstances listed below, an agri-tourism activity provider is not liable for any injury to or death of a participant resulting from an agri-tourism activity. I understand that I have accepted all risk of injury, death, property damage and other loss that may result from an agri-tourism activity. I understand that an agri-tourism activity provider is not protected from liability if the provider: (1) Performs an act in a grossly negligent manner and causes injury or damages to a participant. (2) Purposefully causes a participant’s injury. (3) Acts or fails to act in a way that constitutes criminal conduct. (4) Recklessly fails to warn or guard against a dangerous condition that causes injury or damages to a participant. A dangerous condition is a condition that creates an imminent and substantial risk of injury or damages to a participant.
Notice of filming and photography:
When you enter a Cedar Meadow Farm event or program, you enter an area where photography, audio, and video recording may occur.
By entering the event premises, you consent to interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, webcasts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by Cedar Meadow Farm and its affiliates and representatives. Images, photos and/or videos may be used to promote similar Cedar Meadow Farm events in the future, highlight the event and exhibit the capabilities of Cedar Meadow Farm. You release Cedar Meadow Farm, its officers and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or or sound recordings.
By entering the event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, webcasting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, webcasting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recording taken by Cedar Meadow Farm or the person or entity designated to do so by Cedar Meadow Farm.
You have been fully informed of your consent, waiver of liability, and release before entering the event.
